Diversion Program


The Spencer County Prosecutor's Office operates a pre-trial diversion program pursuant to Indiana Statutory authority which is designed to allow qualified offenders who comply with certain terms and conditions to earn a dismissal of their criminal cases or infraction violations. However, the offender must pay a fee and is placed on informal probation for a period of time. In addition, misdemeanor offenders are generally required to complete additional requirements such as evaluations, counseling, educational classes, and/or perform community service while they are on informal probation in order to obtain dismissal of their cases. Offenders who have been ticketed or charged with infractions and misdemeanors in Spencer Circuit Court or Rockport City Court are eligible for the program if they meet the entrance requirements which in general are no prior arrests or convictions in the last year and the willingness to follow whatever requirements the prosecutor's office may impose upon them. Proceeds from Deferrals are used as requested by the Prosecutor and approved by the County Council and in Spencer County are used to help pay for the budget of the Prosecutor's Office.

Infractions - Diversion Fee is $137.00

- No new offenses for 6 months

Misdemeanors - Diversion Fee is $222.00
- Informal Probation for 1 year
- No new offenses for 1 year
- Additional requirements as set by Prosecutor

Check Deception - Diversion Fee is $110.00
- Informal Probation for 1 year
- No new offenses for 1 year
- Additional requirements as set by Prosecutor

Those who enter the Diversion Program are required to sign a written agreement with the Prosecutor's Office. If someone enters the Diversion Program and commits a new offense while they are on informal probation (deferral), they face not only the new charge but the charge that was being deferred can be brought back up on the Court's calendar against them.
